Spill Prevention Control and Countermeasure Plan (SPCC Plan)
The owner or operator of an onshore oil and fuel storage facility classified as a Tier II Qualified Facility meeting the applicable EPA criteria of Title 40 Code of Federal Regulations (40 CFR) Chapter 112.3(g)(2) must fill out and have on site a Spill Prevention Control and Countermeasure Plan (SPCC). A qualified facility is one that has had no single discharge exceeding 1,000 U.S. gallons or no two discharges each exceeding 42 U.S. gallons within any 12 month period in the three years prior to the SPCC Plan self-certification date.
Under Section 112.3(a)(1), you must prepare and implement a plan by November 10, 2011, or if already prepared, you must maintain the plan and amend it as necessary to stay in compliance, and implement the amended plan by the same November 10, 2011. If a new facility is planned to become operational after November 10, 2011, an SPCC plan must be prepared and in place prior to beginning operations at the new site.
This SPCC Plan when completed must be maintained at the facility, if the facility is normally attended at least four hours per day, or at the nearest field office if the facility is not attended, and have the Plan available to the Regional Administrator for on-site review during normal working hours.
